What is Family Violence? An act by a member of a family against another member of the family that is intended to result in physical harm, bodily injury, or assault; or, that is a threat that reasonably places the member in fear of imminent physical harm, bodily injury, or assault.
WHY Seek Help Through VAWA?
- Victim may self-petition
- Victim may file for immigration relief without abuser’s assistance or knowledge.
- With approved I-360 petitioner may obtain:
Work permit Deferred deportation
Who Can Self-Petition?
- The battered spouse of a U.S. citizen or a lawful permanent resident.
- The parent of a child who has been abused by your U.S. citizen or LPR
spouse.
- A child and stepchild under 21 years of age and unmarried who is abused by your U.S. citizen or LPR parent.
- Abused parents of US citizens
- Spouses of A (diplomat), E (treaty-based travel), G(foreign government
employee) and H (business) visa holders may apply for employment authorization
